Information We Collect and How We Use Your Personal Information

Personal Information We Collect
Smith collects and uses personal information about applicants and other prospective students, including Continuing Education students, (referred to collectively as “applicants”). If you are or have been an applicant, we may collect and use the following types of personal information about you:
- Information and supporting documentation that you provide in your application, including through third parties
- Related application materials (e.g., recommendations, references, and test scores)
- Information that you have permitted a third party, such as The College Board, to release (e.g., AP or PSAT scores, demographic information, family information, academic information)
- Contact information for prospective students that we receive from other institutions and from vendors who conduct advertising activities for us
- Financial information, including financial information about your family members (e.g., information collected in connection with applications for financial aid)
- Employment, education and contact information, including information about your family members (e.g., information collected in connection with applications)
- Survey responses (if you choose to respond to a survey sent by us or on our behalf)
How We Use Your Personal Information
Your personal information is used primarily to evaluate your application and related activities, such as evaluating requests for financial aid, communicating with you about your application, and other administrative functions related to the admissions and enrollment process. We may also use or disclose your personal information for the following purposes:

- To provide you with information about Smith and events that you might be interested in attending

Students, Faculty, and Staff
Personal Information We Collect
When you are a student at the College, or a member or prospective member of the faculty and staff, we maintain records containing your personal information. We may collect and use the following types of personal information about you, as applicable:
- Your contact information and biographical data (e.g., name, address, date of birth, race, ethnicity, family information)
- Application materials and supporting documents (e.g., applications for admission or employment)
- Copies of identification documents and other official documents (e.g. driver’s license, I-9 form, passport/visa information)
- Employment and/or educational records (e.g., job history, job reviews, transcript information)
- Academic work product and related information (e.g., research and course-related content)
- Records about your other activities (e.g., involvement in clubs, disciplinary actions and similar incidents)
- Financial information (e.g., payroll information, information related to tuition payments)
- Health information (Most health information about College students is stored in the records of Smith Health and Counseling Services for the purpose of providing you with health care services, although some is stored in other locations, such as disability services documentation submitted to Student Services. Please refer to the Smith Health and Counseling Services Privacy Practices for additional information regarding the use and disclosure of health information in connection with the Smith Health Services.)
- Information about technology usage (e.g., IP addresses, software downloads)
How We Use Your Personal Information
We use this information for the following purposes as applicable:
- To provide educational, employment and/or related services (e.g., maintaining relevant records of your studies or employment, providing you with access to facilities and support services, such as counseling and IT services)
- To administer the financial aspects of the relationship (e.g., payroll, collecting tuition, coordinating with lenders or other funders)

Personal Information We Collect
Smith holds personal information related to its alums and other supporters (such as donors, prospective donors, volunteers, and family members of students). If you are an alum or other supporter, we may collect and use the following types of personal information about you:
- Academic information (e.g., major, transcript, degree)
- Biographical information (e.g., name, date of birth)
- Contact information (e.g., address, email, phone, social, websites)
- Your activities at as a student (e.g., cohorts, student clubs/orgs, JYA, Athletics, internships, etc.)
- Your involvement with Smith and other interests (e.g., volunteer service, attendance at events, philanthropic interests)
- Family information (e.g., marital status, name of spouse)
- Health information (e.g., disability, food allergies)
- Financial information (e.g., history of donations, wealth information)
- Employment information
We collect data about alums and other supporters from various sources, including directly from the individual (for example, by filling out a form on our website) and from other individuals (for example, students provide information about family members). We also retain information from your student records if you studied here. We also collect information from publicly available sources, such as social media, and from third parties, such as companies that conduct wealth screening or other people that might know you and your philanthropic interests.
How We Use Your Personal Information
Your personal information is used for the following purposes:
- Sending you informational publications (e.g. workshop and event notifications, and Smith publications)
- Conducting surveys
- Providing services
- Connecting you with meaningful opportunities to engage with Smith: philanthropically, volunteering, events and programs, etc.
- Conducting wealth analysis and research to understand your philanthropic interests and ability to give in order to ensure that our fundraising efforts are tailored to your interests

Personal Information We Collect
The Smith website is an information system intended to present an integrated view of the College to prospective students, alumni, the members of the Smith community, and others with an interest in the College. Transfer of Information to the United States
Smith is located in the United States. Information we collect from you will be processed by Smith in the United States. The College may also transfer your personal information to third parties, including our vendors, as described in this notice that may be located outside of the European Economic Area (“EEA”).
The United States has not sought nor received a finding of “adequacy” from the EEA, which means that the data protection laws in the United States may not offer you the same protections as in the country in which you are residing when the personal information is collected. With respect to transfers outside the EEA, Smith generally relies on derogations for specific situations. In some circumstances, the College may enter into standard contractual clauses governing the import or export of personal information, or rely on your consent. In all cases, Smith endeavors to apply suitable safeguards to protect the privacy and security of your personal information, particularly sensitive data, and to use it in a manner that is consistent with this Privacy Notice.
Retention of Data
The College retains personal information about students and alumni indefinitely for the purpose of alumni relationships, academic record-keeping, and archiving purposes. Other personal information will be retained in accordance with applicable Smith data retention policies.
Communications from the College
The College periodically sends marketing communications to alums, parents, supporters, and other members of the Smith community, such as magazines, newsletters, event invitations, and fundraising information. If you would like to request that the College limit or stop these marketing communications with you, please contact us at privacy@smith.edu. If you request to be removed from our mailing lists, we will retain your contact information to ensure that we do not continue to contact you for these purposes. If applicable, we will also continue to process your personal information for other purposes consistent with this Privacy Notice.
Individual Rights
If you are located in the EEA, you may have the following legal rights under applicable law with respect to the personal information processed by the College:
- To withdraw consent at any time, if we are processing your personal information on the basis of consent
- To access the information that Smith has about you
- To request that Smith rectify or erase your information
- To request that Smith restrict the way it uses your information
- To object to the way Smith uses your information
- To ask Smith to transfer your information to someone else
- To lodge a complaint with a data protection authority in the EEA

- 6.5 Requisite Permission for Names and Email Addresses. In providing us with a third party's name and e-mail address when using the "send an ePostcard" option available on our Web site, you represent and warrant that you have first obtained permission from the third party to do so.

- General. These Terms shall be governed in all respects by the Commonwealth of Massachusetts without giving effect to its conflicts of law provisions. Both parties submit to the personal jurisdiction of and venue in, the state and federal courts sitting in the judicial district that includes Hampshire County, Massachusetts. The parties further agree that any cause of action arising under these Terms shall exclusively be brought in such courts. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These Terms and the terms and conditions contained herein set forth the entire understanding and agreement between you and us with respect to the subject matter hereof and supersede any prior or contemporaneous understanding, whether written or oral.
- Claims Against Other Users. You agree that in the event that you have any right, claim or action against visitors or other users of our Web site arising out of that person's use of the Web site, then you will pursue such right, claim or action independently of and without recourse to us.
- Translations. These Terms may be translated into languages other than English (collectively, "Translations"). Any communications sent by us to you shall be sent in English. Notice and Take-Down Procedure
Written notification of allegedly infringing work must be sent to the college's agent at the above address. The notice must include ALL of the following:
- A physical or digital signature of the owner of an exclusive copyright right (i.e., the copyright owner himself or the owner's exclusive licensee of the right(s) to reproduce, distribute, display, perform or create derivatives) or the owner's authorized agent;
- A description of the works claimed to be infringed;
- A description of the allegedly infringing works, sufficient to enable the agent to find them;
- Sufficient information to enable the agent to contact the complainer;
- A statement that the complainer believes in good faith that the use of the material is not authorized by the owner, the owner's agent or the law; and
- A statement that the information in the notice is accurate and, under penalty of perjury, that the complainer is authorized to act on behalf of the owner of one or more exclusive copyright rights.
Individuals who wish to submit a notice are referred to the Digital Millennium Copyright Act Section 512 (c) (3) (A) (for notices alleging that content infringes) or Section 512 (d) (3) (for notices that allege that information location tools such as links contribute to infringement of a work).
The college's agent will review the notification to be sure it substantially conforms to the statutory requirements. If the notice substantially conforms, the agent will take reasonable steps to notify the page owner of the allegation of infringement and secure voluntary take-down of the work or disable access to the work.
If the notice fails substantially to conform, but the problems are with requirements 1, 5 or 6 above, the agent will contact the complainer and try to obtain the missing information. If the complainer provides substantially conforming information, the agent will notify the page owner of the allegation of infringement and secure voluntary take-down of the work or disable access to the work.
If the notice is nonconforming with respect to requirements 2, 3 or 4, or if the complainer does not respond to the agent's request for additional information, the agent will ignore the notice. The agent will archive the notice along with a copy of any correspondence attempting to obtain additional information.
Counter-Notification Procedure
After the page owner voluntarily takes down the page or the college's agent disables access to it, the college or the page owner may decide to proceed to counter-notification.
Counter-notices can only claim: (1) that the copyright owner is mistaken and that the work is lawfully posted or (2) that the work has been misidentified. A page owner may assert that a use of another's work qualifies as a fair use and so the copyright owner is "mistaken" in characterizing it as infringing.
Counter-notices must contain ALL of the following:
- A physical or digital signature of the page owner;
- A description of the material removed and its location before it was removed;
- A statement that the page owner believes in good faith that the material was removed by mistake or because it was misidentified;
- The page owner's name, address and phone number and his or her consent to jurisdiction of the Federal District Court for that address or any Federal District Court if the address is foreign; and
- A statement that the page owner will accept service of process from the complainer.
The page owner must send the counter notification to the college's agent who will:
- Promptly send a copy of any substantially conforming counter-notice to the complainer indicating that the college will restore access in 10 business days; and
- Restore access to the allegedly infringing work within 10 to 14 business days after the day the agent receives the counter-notice, unless the agent first receives a notice from the complainer that he or she has filed an action seeking a court order to restrain the page owner.
If the agent receives notice that the complainer has filed an action seeking a court order to restrain the page owner, the agent will:
- Not repost the allegedly infringing work while court action is pending;
- Forward the notice to the page owner; and
- Forward the notice to the appropriate college administrator (the Provost/Dean of the Faculty if the page owner is a faculty member, the Dean of the College if the page owner is a student, or the Vice President for Finance and Administration if the page owner is a staff member).
